The Constitutional Council will take over the responsibility of, and management of, the US Marshalls Service.

Remarks

The Constitutional council needs a pool of people trained and empowered to perform certain law enforcement functions.  For example, it needs people to provide and ensure court security (sometimes called bailiffs), to serve subpoenas, and if necessary, to take people into custody.

Why must the US Marshal Service actually need to be under the management of the constitutional Council?  Probably most of the time it may not need to be under the management and control of the Constitutional Council, but consider if the Council is dealing with a recalcitrant individual in the employ of the Department of Justice itself.  It is simply not acceptable in such a situation for the Council to have to request from the DOJ the service of a US Marshal so that they can serve the individual a subpoena or take him into custody.  In all likelihood the rest of the government will need the services of the US Marshals more than the Constitutional Council.   That is OK; anytime the government needs such services they can request them, and in almost any imaginable situation the Constitutional Council will grant such requests.

Note further that, as it is envisioned that where issues of constitutionality are to be settled by trial in a court, it would not be acceptable that the security of that court be in the hands of any other than the Constitutional Council’s.
